Agreement to Terms

By accessing or using MapMarket ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

MapMarket is an online marketplace platform that allows users to:

• Create and upload custom Google My Maps
• Sell maps to other users
• Purchase and download maps from other creators
• Rate and review maps
• Manage their map library and creator dashboard

User Accounts

Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years old to create an account
• One person may not maintain multiple accounts

Account Responsibilities

• You are responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• Keep your contact information current and accurate

Content and Maps

Creator Responsibilities

When you upload maps to our platform, you represent and warrant that:

• You own or have the necessary rights to the content
• Your maps do not infringe on any third-party rights
• Content is accurate and not misleading
• Maps comply with all applicable laws and regulations
• Content does not contain harmful, offensive, or illegal material

Prohibited Content

You may not upload maps or content that:

• Promotes illegal activities or violence
• Contains adult content or is inappropriate for general audiences
• Violates intellectual property rights
• Contains private or confidential locations without permission
• Includes spam, malware, or malicious content
• Promotes hate speech or discrimination

Content License

By uploading content to MapMarket, you grant us a non-exclusive, worldwide, royalty-free license to:

• Display your maps on our platform
• Create previews and thumbnails
• Distribute maps to purchasers
• Use content for platform promotion (with attribution)

Payments and Pricing

Payment Processing

• All payments are processed securely through Stripe
• Prices are displayed in USD unless otherwise specified
• Payment is required before accessing purchased content
• We do not store payment card information on our servers

Creator Earnings

• Creators receive a percentage of sales after platform fees
• Payouts are processed through Stripe Connect
• Minimum payout thresholds may apply
• Tax reporting is the creator's responsibility

Refunds

Due to the digital nature of our products, refunds are generally not provided. However, we may consider refunds in cases of:

• Technical issues preventing download
• Maps that significantly differ from their description
• Duplicate purchases made in error

Acceptable Use

You agree not to:

• Use the platform for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Create fake accounts or impersonate others
• Engage in fraudulent activities
• Circumvent our payment systems
• Scrape or harvest data from our platform
• Share purchased maps with unauthorized third parties

Intellectual Property

Platform Rights

MapMarket, its design, functionality, and original content are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, or distribute our platform content without permission.

User Content Rights

You retain ownership of your original content. However, by using our platform, you agree that:

• Purchased maps are for personal use unless otherwise specified
• Commercial use of purchased maps requires explicit permission
• Redistribution of purchased maps is prohibited

Privacy and Data

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Content Moderation

We reserve the right to:

• Review and moderate all content uploaded to our platform
• Remove content that violates these terms
• Suspend or terminate accounts for violations
• Refund purchases of removed content at our discretion

Disclaimer of Warranties

MapMarket is provided "as is" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free service
• Accuracy of user-generated content
• Security of data transmission
• Availability of specific maps or features

Limitation of Liability

To the maximum extent permitted by law, MapMarket shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.

Termination

We may terminate or suspend your account at any time for violations of these terms. You may also delete your account at any time. Upon termination:

• Your access to the platform will be immediately revoked
• Previously purchased content may remain accessible
• Outstanding payments will be processed according to our policies

Changes to Terms

We may update these Terms of Service from time to time. We will notify users of significant changes by posting the updated terms on our website. Your continued use of the service constitutes acceptance of the updated terms.

Governing Law

These terms are governed by the laws of the United States and the state of California, without regard to conflict of law principles.
